United States District Court, Northern District of California
Recently, a client’s conviction was successfully challenged resulting in a 10-year reduction in his sentence out of the United States District Court, Northern District of California by firm owner and senior attorney David J. Cohen with the assistance of senior attorney Jason T. Campbell. Capitalizing on recent Supreme Court decisions invalidating part of a federal statute prohibiting the use of a firearm in relation to a crime of violence (18 U.S.C. §924(c)), firm owner David J. Cohen, Esq. successfully challenged a defendant’s conviction resulting in a 10-year reduction in his client’s sentence. In the Federal District Court for the Northern District of California, Judge Charles R. Breyer granted the defense motion, made pursuant to 28 U.S.C. § 2255, and, over vigorous opposition from the United States Attorney, vacated the mandatory consecutive 10-year sentence, resulting in an anticipated 2023 release date (approximately one year away!).
